John Alexander, a partner with Cox Taylor Lawyers representing the petitioners, stated, “They’re asking the court to determine the limits of the recent legislation and how far it goes, taking away people’s rights to continue the short-term rental operations that they have had legally operated in the province for the last several years.”

The petitioners claim that the legislation infringes on their "vested rights" to continue their business, especially in areas like Tofino and Kelowna, where homes were specifically built and sold for intermittent vacation rental use. Orino Rogers, spokesperson for the Property Rights Association, said, “Today is our first day of court proceedings to challenge this act and find out if it is unjust, if it’s government overreach, and if it’s canceling people’s vested rights.”

The property owners argue that the properties were marketed and sold with licenses to operate short-term rentals, and changing these rules now is unfair. In contrast, Premier Eby defends the restrictions as essential for addressing the housing shortage in B.C., which is critical for the province’s rapidly growing population.
