Summary
This enactment amends the Canada Post Corporation Act to (a) provide that the Corporation must not refuse to provide a postal service within Canada for the interprovincial collection, transmission and delivery — direct to consumers — of beer, wine or spirits; (b) give the Corporation the sole and exclusive privilege, within Canada, of collecting, transmitting and delivering interprovincially — direct to consumers — beer, wine or spirits; (c) create an exception to this privilege for trusted carriers; (d) authorize the Governor in Council to make regulations respecting trusted carriers; and (e) provide for publication requirements.

R.S., c. C- 10 Canada Post Corporation Act 1 Section 2 of the Canada Post Corporation Act is amended by adding the following in alphabetical order: beer has the same meaning as in section 4 of the Excise Act ; ( bière ) spirits has the same meaning as in section 2 of the Excise Act, 2001 ; ( spiritueux ) wine has the same meaning as in section 2 of the Excise Act, 2001 ; ( vin ) 2 The Act is amended by adding the following after section 5: Service 5. 1 The Corporation shall not refuse to provide a postal service within Canada for the interprovincial collection, transmission and delivery — direct to consumers — of beer, wine or spirits. 3 (1) Subsection 14(1) of the Act is replaced by the following: Exclusive privileges 14 (1) Subject to section 15, the Corporation has, within Canada, the sole and exclusive privilege of ( a ) collecting, transmitting and delivering letters to the addressee thereof; and (b) collecting, transmitting and delivering interprovincially — direct to consumers — beer, wine and spirits. (2) Subsection 14(1) of the Act is replaced by the following: Exclusive privileges 14 (1) Subject to sections 15 and 15.1 , the Corporation has, within Canada, the sole and exclusive privilege of ( a ) collecting, transmitting and delivering letters to the addressee thereof; and (b) collecting, transmitting and delivering interprovincially — direct to consumers — beer, wine and spirits. 4 The portion of subsection 15(1) of the Act before paragraph (a) is replaced by the following: Exception — letters 15 The exclusive privilege referred to in paragraph 14(1)( a ) does not apply to 5 The Act is amended by adding the following after section 15: Exception — beer, wine and spirits 15. 1 The exclusive privilege referred to in paragraph 14(1)(b) does not apply to beer, wine or spirits collected, transmitted or delivered by a carrier designated as a trusted carrier under this Act. 6 The Act is amended by adding the following after section 20: Regulations 20.1 (1) The Governor in Council may make regulations respecting trusted carriers, including regulations (a) establishing processes and criteria for the designation of trusted carriers, such as criteria in respect of age verification protocols and secure handling and delivery procedures; (b) designating a common carrier or class of common carriers as a trusted carrier; and (c) respecting the interprovincial collection, transmission and delivery — direct to consumers — of beer, wine and spirits by trusted carriers, including oversight mechanisms. List of trusted carriers (2) The Minister must cause to be published on the Minister’s departmental website a list of carriers designated as trusted carriers and must update the list within 30 days after the day on which a carrier is designated as a trusted carrier or loses their designation. Designation by Minister (3) The Minister may, in the absence of regulations, designate a common carrier or class of common carriers as trusted carriers. Coming into Force Three months after royal assent 7 (1) Sections 1 and 2, subsection 3(1) and section 6 come into force three months after the day on which this Act receives royal assent. One year after royal assent (2) Subsection 3(2) and sections 4 and 5 come into force one year after the day on which this Act receives royal assent.
