C-44 First Session, Thirty-ninth Parliament, 55 Elizabeth II, 2006 HOUSE OF COMMONS OF CANADA BILL C-44 An Act to amend the Canadian Human Rights Act first reading, December 13, 2006 THE MINISTER OF INDIAN AFFAIRS AND NORTHERN DEVELOPMENT 90401 SUMMARY This enactment repeals section 67 of the Canadian Human Rights Act and provides for a statutory review, within five years after the enactment receives royal assent, of the effects of the repeal by any parliamentary committee that may be designated or established for that purpose. It also contains a transitional provision with respect to aboriginal authorities. Nothing in this Act affects any provision of the Indian Act or any provision made under or pursuant to that Act. La présente loi est sans effet sur la Loi sur les Indiens et sur les dispositions prises en vertu de cette loi. REVIEW AND REPORT Review 2. (1) Within five years after the day on which this Act receives royal assent, a comprehensive review of the effects of the repeal of section 67 of the Canadian Human Rights Act shall be undertaken by any committee of the Senate, the House of Commons or both Houses of Parliament that may be designated or established for that purpose. Report (2) The committee shall, within a year after a review is undertaken under that subsection, or within any further time that may be authorized by the Senate, the House of Commons or both Houses of Parliament, as the case may be, submit a report on the review to that House or both Houses. TRANSITIONAL PROVISION Indian Act 3. Despite section 1, an act or omission by an aboriginal authority that was made in the exercise of powers or the performance of duties and functions conferred or imposed by or under the Indian Act shall not constitute the basis for a complaint under Part III of the Canadian Human Rights Act if it occurs within six months after the day on which this Act receives royal assent.
