Bill C-470: An Act to amend the Access to Information Act (response time)

C-470 Second Session, Thirty-ninth Parliament, 56 Elizabeth II, 2007 HOUSE OF COMMONS OF CANADA BILL C-470 An Act to amend the Access to Information Act (response time) first reading, October 30, 2007 Mr. Bagnell 39155 SUMMARY This enactment amends the Access to Information Act to provide that, if a request for access to a record under that Act is still outstanding one hundred days after the request is received, the head of the government institution to which the request was made shall send a report to the person who made the request and to the Information Commissioner, setting out a full explanation of the delay and the projected completion date. The information provided shall be included in the Information Commissioner’s annual report to Parliament. A-1 Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows: 1. The Access to Information Act is amended by adding the following after section 9: Report after one hundred days 9.1 (1) Where a request for access to a record under this Act is still outstanding one hundred days after the request is received, the head of the government institution to which the request was made shall send a report to the person who made the request and to the Information Commissioner setting out a full explanation of the delay and the projected completion date. Annual report (2) The number of requests that were still outstanding one hundred days after they were received, and the government institutions responsible for those requests, shall be included in the annual report that the Information Commissioner is required to submit to Parliament under section 38.
