This enactment amends the Canada Shipping Act, 2001 to prohibit the abandonment of a vessel.

An Act to amend the Canada Shipping Act, 2001 (prohibition against abandonment of vessel)

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1. Section 210 of the Canada Shipping Act, 2001 is amended by adding the following in alphabetical order:
“deemed abandoned”« réputé abandonné »
“deemed abandoned”, in respect of a vessel, means a vessel to which the circumstances prescribed under paragraph 244(d) apply or a vessel that
(a) has been left anchored or moored in the same area of any Canadian waters for more than 30 days without authorization or without any surveillance or monitoring;
(b) has been left adrift in any Canadian waters for more than 30 days;
(c) has been left on private property without authorization from the owner; or
(d) has been left anchored, moored or adrift in any Canadian waters and is in danger of sinking or breaking up, is obstructing a waterway or poses a serious and imminent danger to human health or safety, the environment or property.
2. Subsection 226(1) of the English version of the Act is replaced by the following:
Abandoned vessels
226. (1) The Minister may sell a vessel that is deemed abandoned and may, by bill of sale, give the purchaser a valid title to it free from any mortgage or other claim on the vessel that exists at the time of the sale.
3. The Act is amended by adding the following after section 246:
Offence — abandonment of vessel
246.1 Every person who, being the owner of a vessel that is not wrecked, stranded or in distress, abandons the vessel and does not take all reasonable measures to resume control and possession of the vessel commits an offence and is liable on summary conviction to a fine of not more than $100,000 or to imprisonment for a term of not more than one year, or to both.
