SUMMARY
This enactment amends the Criminal Code to specify what constitutes exploitation for the purpose of establishing whether a person has committed the offence of trafficking in persons. It also amends the Judges Act to provide that seminars established for the continuing education of judges must include seminars on trafficking in persons.

An Act to amend the Criminal Code and the Judges Act (trafficking in persons)
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1 Subsections 279.04(1) and (2) of the Criminal Code are replaced by the following:
Exploitation
279.04 For the purposes of sections 279.01 to 279.03, a person exploits another person if they engage in conduct that causes the other person to provide, or offer to provide, labour or a service and that involves – in relation to any person – the use or threatened use of force or another form of coercion, the use of deception or fraud, the abuse of a position of trust, power or authority or any other similar act.

Judges Act
2 Section 60 of the Judges Act is amended by adding the following after subsection (2):
(3) In establishing seminars for the continuing education of judges, the Council shall offer seminars in respect of trafficking in persons the content of which includes, in particular, the harm that is caused to victims of or witnesses to trafficking in persons.
Coordinating Amendment
2015, c. 16
3 (1) If section 1 of this Act comes into force before section 2 of An Act to amend the Criminal Code (exploitation and trafficking in persons) (the “other Act”), then that section 2 is repealed.
(2) If section 1 of this Act comes into force on the same day as section 2 of the other Act, then that section 2 is deemed never to have come into force and is repealed.
