Bill C-346: An Act to amend the Canada Shipping Act, 2001 (certificate of competency)

2001, c. 26 Canada Shipping Act, 2001 1 The definition qualified person in section 2 of the Canada Shipping Act, 2001 is amended by striking out “or” at the end of paragraph (a) and by adding the following after that paragraph: (a.1) a foreign national within the meaning of subsection 2(1) of the Immigration and Refugee Protection Act who is referred to in subsection 88(1); or 2 Subsection 88(1) of the Act is replaced by the following: Holder of a certificate of competency 88 (1) Only the following persons may hold a certificate of competency that is issued under this Part: ( a ) a Canadian citizen; ( b ) a permanent resident within the meaning of subsection 2(1) of the Immigration and Refugee Protection Act ; (c) a foreign national within the meaning of subsection 2(1) of the Immigration and Refugee Protection Act who holds a diploma issued by a prescribed Canadian maritime institution and for whom a permanent residence application under that Act is being processed. 3 Section 100 of the Act is amended by adding the following after paragraph (c): (c.1) designating Canadian maritime institutions for the purpose of subsection 88(1);
