First Session, Forty-first Parliament, 60-61-62 Elizabeth II, 2011-2012-2013 STATUTES OF CANADA 2013CHAPTER 35 An Act to amend the Employment Insurance Act (incarceration) ASSENTED TO 26th JUNE, 2013 BILL C-316 SUMMARY This enactment amends the provisions of the Employment Insurance Act that allow for qualifying periods and benefit periods to be extended as the result of time spent by the claimant in a jail, penitentiary or other similar institution so that they apply only if the claimant is not found guilty of the offence for which he or she was being held or any other offence arising out of the same transaction. Paragraph 8(2)(b) of the Employment Insurance Act is replaced by the following: (b) confined in a jail, penitentiary or other similar institution and was not found guilty of the offence for which the person was being held or any other offence arising out of the same transaction; 2. Paragraph 10(10)(a) of the Act is replaced by the following: (a) confined in a jail, penitentiary or other similar institution and was not found guilty of the offence for which the claimant was being held or any other offence arising out of the same transaction; 3. Paragraph 152.11(11)(a) of the Act is replaced by the following: (a) confined in a jail, penitentiary or other similar institution and were not found guilty of the offence for which they were being held or any other offence arising out of the same transaction; TRANSITIONAL PROVISION Transitional 4. Paragraphs 10(10)(a) and 152.11(11)(a) of the Employment Insurance Act, as enacted by sections 2 and 3, respectively, do not apply to the benefit period of a claimant or a self-employed person, as the case may be, in respect of any week for which the claimant or the self-employed person was confined in a jail, penitentiary or other similar institution before the coming into force of this Act.
