C-46 CRIMINAL CODE 1. Section 145 of the Criminal Code is amended by adding the following after sub-section (2): Failure to comply with a condition (2.1) Every person who fails or refuses to comply, without reasonable excuse, with a condition of parole, statutory release or a long-term supervision order issued under the Corrections and Conditional Release Act, a condition referred to in section 134.1 of that Act, or a condition of a temporary absence authorized under the Prisons and Reformatories Act is guilty of (a) an indictable offence and is liable to imprisonment for a term not exceeding two years less a day; or (b) an offence punishable on summary conviction. 1992, c. 20 CORRECTIONS AND CONDITIONAL RELEASE ACT 2. The Corrections and Conditional Release Act is amended by adding the following after the heading “Suspension, Termination, Revocation and Inoperativeness of Parole, Statutory Release or Long-term Supervision” before section 135: Parole supervisor 134.3 If it comes to the knowledge of a parole supervisor that an offender has committed a breach of a condition of parole, statutory release or a long-term supervision order issued under this Act, of a condition referred to in section 134.1, or of a condition of a temporary absence authorized under the Prisons and Reformatories Act, the parole supervisor shall inform the Parole Board of Canada and the Service, and the Attorney General and police force that have jurisdiction in the place in which the breach of the condition occurred, of the breach and the circumstances surrounding the breach.
